There is no Data Protection Officer, as this is not mandatory in this case in accordance with Article 34 of the LOPDGDD and Article 37 of the GDPR.

Purposes of processing and legal bases

We process personal data for the following purposes and on the following legal grounds:

– Respond to enquiries received via the website’s contact form, by email or by telephone.

Legal basis: consent of the data subject (Article 6(1)(a) of the GDPR) or the taking of steps prior to entering into a contract (Article 6(1)(b) of the GDPR).

– Management of client relationships and estate agency services (viewings, agency mandates, sales of residential and commercial properties).

Legal basis: performance of a contract or the implementation of pre-contractual measures (Article 6(1)(b) of the GDPR).

– Receiving and managing enquiries/leads from property portals (ThinkSpain, Idealista or others).

– Compliance with legal obligations (tax, commercial and anti-money laundering).

– Sending marketing communications about properties or similar services (only if consent has been given).

Legal basis: consent (Article 6(1)(a) of the GDPR) or legitimate interest in relation to previous customers (Article 6(1)(f) of the GDPR and Article 21(2) of the LSSI).

Data retention

– Enquiries and leads that do not convert into customers: a maximum of 12–24 months from the last contact.

– Customer and transaction data: for the duration of the contractual relationship and, subsequently, for the periods required by law (generally between 5 and 10 years in accordance with commercial and tax obligations).

– Marketing communications: until consent is withdrawn or the right to object is exercised.

Recipients of the data

Rights of data subjects

The data is obtained:

– Via property websites (ThinkSpain, Idealista or others) when the prospective buyer has expressed an interest in a property.
